Photowand is an AI-powered photo editing platform that enables users to create, edit, and enhance images using artificial intelligence technology. The Service allows users to change backgrounds, modify outfits, adjust angles, apply style transfers, generate images from prompts, and perform various other photo editing tasks.

3. Account Registration

To use the Service, you must:

Create an account by providing accurate and complete information
Maintain the security of your account credentials
Be at least 18 years old or have parental consent
Not create multiple accounts to circumvent our policies

You are responsible for all activities that occur under your account.

4. Subscription and Payment

Photowand operates on a credit-based subscription model:

Payment is required upfront before accessing the platform
No free trial is offered
Each photo generation costs 1 credit
Subscription tiers provide a set amount of credits per billing period
Plan upgrades take effect immediately
Plan downgrades take effect at the end of the current billing period
All payments are processed through Stripe
Subscriptions automatically renew unless cancelled

5. Refund Policy

Due to the nature of our AI-powered service and the immediate delivery of credits, all sales are final. We do not offer refunds for unused credits or partial subscription periods. You may cancel your subscription at any time to prevent future charges.

6. User Content and Intellectual Property

Your Content: You retain ownership of all images you upload to the Service. By uploading content, you grant us a license to process, store, and display your images solely for the purpose of providing the Service.

Generated Content: You own the output generated by the Service using your inputs and prompts. However, you are responsible for ensuring your use of the Service and generated content complies with all applicable laws.

Restrictions: You may not use the Service to create or distribute:

Illegal, harmful, or offensive content
Content that infringes on intellectual property rights
Deepfakes or misleading content without proper disclosure
Content that violates the rights or privacy of others

7. Acceptable Use

You agree not to:

Use the Service for any illegal purpose
Attempt to circumvent usage limits or technical restrictions
Reverse engineer or attempt to extract the source code
Use automated systems to access the Service without permission
Resell or redistribute the Service or generated content as a service
Upload images depicting minors without proper authorization

8. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time without notice. We are not liable for any modifications, suspension, or discontinuation of the Service.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease, and any unused credits will be forfeited.

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
